Carter Date: Mon, 27 Feb 1989 12:20:00 -0500 1990-098 Mary Richardson Carter ORDINANCE NO. 9795 AN ORDINANCE CLOSING AND ABANDONING LONGVIEW DRIVE LOCATED SOUTHEAST OF HIXSON PIKE, SOUTHWEST OF SKILLERN DRIVE, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Longview Drive located southeast of Hixson Pike, southwest of Skillern Drive, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Part of Longview Drive, a 40 foot wide right-of-way. To find the true point of beginning of said part of street, start on the southeast line of Hixson Pike some 561 feet southwest of the intersection of the southeast line of Hixson Pike with the southwest line of Skillern Drive, said point being the intersection of the southeast line of Hixson Pike with the northeast line of the existing Longview Drive, thence southeast some 12 feet with Longview Drive to the base-line of the fill slope of the proposed Longview Drive relocation, the true point of beginning, thence with said base-line, and said base-line extended across the proposed driveway extension, southwest some 63.5 feet to the southwest line of the existing Longview Drive, thence southeast some 15 feet with said Longview Drive, thence southeast at a right angle to Hixson Pike some 33 feet to the center line of Longview Drive, thence northeast 20 feet with the southeast line (if extended southwestwardly) of the property owned by Pearl and Mary Lee Richardson to the northeast line of the existing Longview Drive, thence northwest some 90 feet with said existing Longview Drive to the true point of beginning. Said part of street separates part of lot 40 from part of lot 48, Long Hixson Subdivision, as shown by plat of record in plat book 14, page 150, R.O.H.C. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 3. It is understood that the portion of the right-of-way south of proposed abandonment will be reserved for possible use for a greenway development by the Chattanooga Greenway Board. 4. The areas reserved for utility easements must be kept free and clear of all structures. 5. All existing easements are retained. SECTION 3.
